Metal Judgment, its owners, proprietors, agents, and assigns (hereinafter, "Metal Judgment") encourages open communication between members of the Metal Judgment community. We provide this website for fans of metal music and friends to post their opinions. We invite and encourage all members of the Metal Judgment community to participate on this website. All metal music related discussion is welcome. All spam, flames, and off-topic garbage is unwelcome. Any messages are solely the opinion and responsibility of the person posting the message and, consequently, the reliability, accuracy, and truthfulness of their content is beyond the control of Metal Judgment. Metal Judgment has no control over whether that content is of a nature that readers will find offensive, obscene, distasteful and otherwise unacceptable. Metal Judgment has no responsibility for such content. Rather, Metal Judgment is merely providing access to such content as a service to you. CONDITIONS OF USE
This website (the "Site" or "Metal Judgment") is privately owned and operated. By accessing and using this Site, you (the "User" or "you") agree to be bound by all of the terms, conditions and notices contained in this Conditions of Use Agreement (the "Agreement"). User agrees that his or her use of the Site indicates assent and agreement to the terms and conditions stated herein. If User does not agree to all the terms, conditions, and notices contained in the Agreement, User should not use this Site.
A. Each User expressly agrees that use of the Site is at his or her sole risk. Metal Judgment does not warrant that the Site will be uninterrupted or error free; nor does Metal Judgment make any warranty as to the results that may be obtained from use of the Site or as to the accuracy, reliability or content of any information provided through the Site.
B. The disclaimer of liability contained in this section applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, problems due to year 2000 software or hardware compliance, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Each User specifically acknowledges that Metal Judgment is not liable for the defamatory, offensive or illegal conduct of other third parties (including but not limited to credit card fraud), subscribers, members or other Users of the Site and that the risk of injury from the foregoing rests entirely with each User.
C. In no event will Metal Judgment or its agents, employees, officers, shareholders or any person or entity involved in creating, producing or distributing the online services be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the Site or out of the breach of any warranty whatsoever. Each User hereby acknowledges that the provisions of this section C shall apply to all content on the Site.
D. Metal Judgment neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement on the Site, nor for any offensive, defamatory or obscene posting made on the Site by anyone other than our employee spokespersons while acting in their official capacities. Under no circumstances will we be liable for any loss or damage caused by reliance on information obtained through postings on the Site.
E. Metal Judgment does not endorse, warrant or guarantee any product or service offered by a third party through the Site and will not be a party to or in any way monitor any transaction between Users and third party providers of products or services. As with the purchase of a product or service through any medium or in any environment, each User should use his or her best judgment and exercise caution where appropriate.
F. Each User specifically acknowledges that in no event will Metal Judgment, our affiliates nor any of their respective employees or agents be liable for any direct, indirect, incidental, special or consequential damages arising out of (i) the use by such User of any browser owned or operated by any party and/or (ii) the downloading of any software owned or operated by any third party.
G. User will provide their full, real name and real email address when registering with Metal Judgment. This information will not be available to other Users unless User chooses to reveal it. Impersonating other Users and/or Metal Judgment employees is prohibited and will result in immediate removal from the Metal Judgment Community.
H. This Agreement is governed by the laws of the State of New York, U.S.A without giving effect to any principles of conflicts of law. User consents to the exclusive jurisdiction and venue of courts in the State of New York, U.S.A. in all disputes arising out of or relating to the use of this Site. Use of this Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation, this paragraph. Users who use this Site outside of New York do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If any provision of the Agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining provisions.
